Returns, Refunds and Cancellations Policy

This policy applies to purchases made from **Boost & Tune M Lab** (“Boost & Tune”, “we”, “us” or “our”).

1. Australian Consumer Law

Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in this policy excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law.

Where a product or service fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation or other remedy, depending on the circumstances and whether the failure is major or minor.

2. All Sales Are Final

Please choose carefully before placing your order.  Message or email any query on the parts you are considering to buy and we will happily fact check and advise as required for your assurance.

We do not provide refunds, returns, exchanges or store credits for:

* Change of mind
* Ordering the wrong product
* Incorrectly selecting a vehicle, model, engine, transmission or product variation
* Deciding that the product is no longer required
* Selling or changing vehicles
* Cancelling or changing a vehicle build
* Financial, scheduling or other personal circumstances
* Finding the product cheaper elsewhere
* Delays that were disclosed before purchase
* Products that have been installed, attempted to be installed, modified, tuned, programmed, used or damaged

Customers are responsible for reviewing product descriptions, specifications, fitment information, lead times and available options before completing their purchase.

Where fitment is uncertain, customers should contact us and provide their VIN and vehicle details before ordering.

3. Special-Order, Imported and Made-to-Order Products

Many products sold by Boost & Tune M Lab are:

* Special ordered for the customer
* Manufactured to order
* Imported from overseas
* Configured for a particular vehicle
* Ordered from a supplier after the customer places an order
* Subject to international freight, customs charges and import duties

Once we have placed a special order with our supplier, commenced production or incurred costs relating to the order, the order cannot normally be cancelled, changed or returned.

Supplier freight, international shipping charges, customs charges, import duties and other costs incurred in obtaining the product are generally non-refundable in relation to a discretionary return or cancellation.

Estimated lead times are estimates only and may be affected by manufacturing schedules, supplier availability, customs processing and international transport.

A delay does not automatically entitle the customer to cancel an order unless required by the Australian Consumer Law or otherwise agreed by us in writing.

4. Discretionary Returns

A return that is not required under the Australian Consumer Law may only be considered at our sole discretion.

Approval is not guaranteed.

Any discretionary return must be authorised by Boost & Tune before the product is returned. Products sent to us without prior authorisation may be refused and returned to the customer.

To be considered, the product must generally be:

* Unused and uninstalled
* Unmodified
* In new and resalable condition
* Complete with all components, instructions and accessories
* In its original undamaged packaging
* Free from installation marks, damage, contamination or wear

Discretionary returns are not available for:

* Special-order or made-to-order products
* Custom fabricated products
* Products ordered in a particular colour, size or configuration
* Electrical components
* Sensors, control modules or wiring products
* Software, licences or digital products
* ECU, TCU, DME or transmission-related products that have been registered, unlocked, flashed or programmed
* Products that have been fitted or had installation attempted
* Clearance or specially discounted products
* Opened fluids, chemicals or consumable products

5. Restocking and Other Charges

Where we agree to accept a discretionary return, a restocking fee may apply.

The amount will depend on the product and the costs incurred in supplying and returning it. Before approving the return, we will advise you of any applicable deduction.

Deductions may include:

* Supplier restocking or cancellation charges
* International and domestic freight costs
* Customs and import duties
* Inspection and handling costs
* Costs required to return the product to the supplier
* Loss in value caused by damaged or opened packaging
* Missing parts, hardware or accessories

Original delivery charges are not refundable for discretionary returns.

The customer is responsible for return freight, insurance and safe packaging for any discretionary return.

Restocking fees and discretionary-return deductions do not apply where doing so would be inconsistent with the Australian Consumer Law.

6. Faulty, Damaged or Incorrect Products

Contact us promptly where you believe that a product:

* Is faulty or unsafe
* Was damaged during delivery
* Is materially different from its description
* Is not the product you ordered
* Does not perform the function represented to you
* Otherwise fails to meet an applicable consumer guarantee

Please provide:

* Your order number
* The product name
* Your vehicle details and VIN, where relevant
* A clear description of the problem
* Photographs or video showing the issue
* Installation details
* Relevant fault codes, logs or test results
* The installer’s details, where applicable

We may need to inspect or test the product before confirming the appropriate remedy.

For a minor problem, we may provide a repair or another appropriate remedy. For a major problem, the customer may be entitled to choose a replacement or refund as provided by the Australian Consumer Law. 

7. Return Freight for Faulty Products

Please contact us before sending a product back so that we can provide return instructions.

Where the product is confirmed to have a fault covered by the Australian Consumer Law, we will reimburse reasonable return costs where required.

If inspection determines that the product does not have a fault, or that the issue was caused by installation, misuse or another excluded cause, the customer may be responsible for inspection, collection and return-delivery costs. We will provide a reasonable estimate before charging applicable collection or inspection costs. 

8. Installation, Modification and Misuse

A warranty or return claim may be declined where inspection reasonably determines that the problem was caused by:

* Incorrect or incomplete installation
* Installation by an unsuitable or unqualified person
* Failure to follow supplied instructions
* Incorrect calibration or tuning
* Use with incompatible parts
* Incorrect fuel, oil, fluid or consumables
* Overheating, overboosting, detonation or fuel-system failure
* Accident, impact, contamination or water ingress
* Modification of the product
* Motorsport or competition use outside the product’s intended specification
* Normal wear and tear
* Failure to perform required servicing or maintenance

This does not limit any rights that cannot lawfully be excluded under the Australian Consumer Law.

9. Software, Tuning and Digital Products

Software licences, digital files, unlock services, coding services, ECU or TCU calibrations and other electronically delivered products are non-refundable once:

* A licence or activation key has been issued
* The product has been registered to a VIN or vehicle
* Access to the software has been provided
* Unlocking, coding, flashing or tuning work has commenced
* A calibration file has been supplied
* A remote tuning or coding session has commenced or been completed

This exclusion does not apply where the product or service fails to meet a consumer guarantee and a remedy is required under the Australian Consumer Law.

Customers are responsible for confirming hardware, software, ROM, DME, TCU, vehicle and tuning-platform compatibility before purchasing.

10. Order Cancellations

Contact us immediately if you need to request an order cancellation.

An order may only be cancelled before it has been:

* Submitted to our supplier
* Allocated from supplier stock
* Dispatched
* Manufactured or configured
* Imported
* Programmed or registered
* Prepared for installation
* Otherwise incurred non-recoverable costs

Cancellation requests are not guaranteed.

Where we approve a cancellation after costs have been incurred, we may deduct unrecoverable supplier, freight, customs, import-duty, handling and cancellation costs before issuing any balance.

11. Refund Processing

Approved refunds will generally be issued to the original payment method.

Bank, card-provider or payment-platform processing times are outside our control.

We may withhold a discretionary refund until the returned product has been received, inspected and accepted.
